If buying an existing business doesn't sound right for you, but starting from scratch sounds a bit intimidating, you could be suited for franchise ownership. What is a franchise--and how do you know if you're right for one? Essentially, a franchisee pays an initial fee and ongoing royalties to a franchiser. In return, the franchisee gains the use of a trademark, ongoing support from the franchiser, and the right to use the franchiser's system of doing business and sell its products or services. Buying a franchise offers many advantages that aren't available to entrepreneurs starting a business from scratch. Perhaps the most significant is that you get a proven system of operation and training in how to use it. 

New franchisees can avoid a lot of the mistakes startup entrepreneurs typically make because the franchiser has already perfected daily routine operations through trial and error Once you’ve decided a franchise is right for you, start by investigating various industries that interest you to find those with growth potential. Narrow the choices to a few industries you're most interested in; then analyze your geographic area to see if there's a market for that type of business. If so, contact all the franchise companies in those fields and ask them for information. Any reputable company will be happy to send you information at no cost.

Franchising is a methodical system for expanding a business and distributing goods and services through multiple outlets. It works based on the relationship between the brand owner and the local operator, teaming together to skillfully and successfully expand.It's a contractual relationship and while both the franchiser and franchisees share a common brand, each is in a different business in a legal and practical sense.

The Legal Definition

While every franchise is a license, not every license is a franchise under the law. In the United States a license becomes a franchise when three specific elements take place:

  • The franchisee’s business is substantially associated with the franchiser's trademark.
  • The franchisee pays an initial and/or continuing fee for the right to enter and remain in the business.
  • The franchiser exercises control or provides assistance to the franchisee.

It's important to not rely strictly on the federal franchise definition. The definition of a franchise varies significantly under the laws in various states and may include other definition elements including, but not limited to, the franchiser providing a marketing plan or maintaining a community of interest with the franchisee.
